Board Policy – Powers and Duties of the Chief Librarian
Policy Statement
The Chief Librarian of the Fraser Valley Regional Library (“FVRL”), who is appointed as the Chief Executive Officer, has the powers and duties set out in Section 27 of the Library Act R.S.B.C. 1996 c. 264, as amended or replaced (the “Library Act”), including but not limited to, the powers and duties the FVRL board (the “Board”) has assigned to the Chief Librarian.
Purpose
To set out the powers and duties of the Chief Librarian assigned by the Board in accordance with Section 27 of the Library Act.
Scope
This policy applies to all FVRL operations.
Duties and Powers of the Chief Librarian Assigned by the Board
In accordance with Section 27 of the Library Act, the Board assigns the following duties and powers to the Chief Librarian. The Chief Librarian may, subject to section 5 of this Policy:
- make rules for managing the library’s business and for regulating the use of the library’s facilities and services by the public;
- hire and dismiss employees, set the terms of their employment, including fixing their remuneration and duties;
- acquire personal property for library purposes and dispose of personal property; and
- contract, for a term of not more than five (5) years, for professional or other services for library purposes.
Conditions on the Duties and Powers of the Chief Librarian
The duties and powers of the Chief Librarian assigned by the Board, as set out in Section 4 of this Policy, are subject to the following:
- the Board may revoke or otherwise modify the duties and powers set out in this Policy;
- sufficient funding for any action to be taken by the Chief Librarian must be generally referenced and available in the Board approved budget for providing library services, before any such action is taken;
- any restrictions placed on the use of the financial resources or the setting and changing of service levels in relation to any action to be taken by the Chief Librarian, as set out in the Board’s Financial Management Policy, and
- a weighted vote of the Board that is required in relation to any action to be taken by the Chief Librarian, as set out in the Board’s Weighted Vote Policy.
Requirement for a Weighted Vote of the Board for Approval or Amendment of this Policy
The approval of, or amendment to, the Board’s Powers and Duties of the Chief Librarian Policy, must be made by weighted vote of the Board as set out in Section 23 of the Library Act.
